IMPORTANT: These Terms and Conditions apply to all Escorted Tour bookings. By paying the initial booking deposit, you confirm that you have read, understood, and agree to the Terms and Conditions set out below. If you do not agree with these Terms and Conditions, you must notify us in writing within five (5) business days of paying the initial booking deposit and request cancellation and a refund of your deposit. If we do not receive written notice within this five-business-day period, you will be deemed to have accepted the Terms and Conditions, and your booking deposit will become non-refundable.

  1. Agency Status & Regulatory Information

Malaysia Boutique Tours (“we”, “us”, or “our”) is a travel advisory and marketing division operating under Center Holidays Inc., an Ontario-registered retail travel agency.

All bookings, payments, and travel arrangements are processed through Center Holidays Inc., which is registered as a travel retailer under the laws of the Province of Ontario and regulated by the Travel Industry Council of Ontario (TICO) pursuant to the Travel Industry Act, 2002 (Ontario).

  1. Bookings Terms and Conditions

Bookings may be made through our Travel Counselor. To ensure the best selection and availability, we recommend reserving your tour as early as possible. All tour prices are quoted in Canadian dollars (CAD).

  1. Guaranteed Departures

If a tour is not designated as a guaranteed departure and must be cancelled due to insufficient enrolment, we will make every reasonable effort to offer you an alternative tour. If the alternative is not acceptable, all payments received will be refunded in full, which will constitute full settlement.

We are not responsible for any additional expenses incurred, including but not limited to visa fees, independently purchased airfare, or any other related costs or compensation. Notice of cancellation due to insufficient enrolment will be provided approximately 60 days prior to the scheduled departure date.

  1. Escorted Tours

We are committed to delivering a true “small group experience.” If a scheduled tour has fewer than 10 participants, we may offer a small-group surcharge to allow the tour to operate as planned rather than cancelling the departure.

This optional surcharge, which may be up to 10% of the tour price, helps cover the additional costs associated with operating a smaller group. You will have the choice to accept the surcharge to proceed with the tour as scheduled. Notice of any small-group surcharge will be provided approximately 60 days prior to departure.

  1. Final Payment Policy

A non-refundable deposit of 25% per person is required at the time of booking to confirm your reservation. Final payment is due 60 days prior to departure. For bookings made within 60 days of the departure date, full payment is required at the time of booking.

Final payments are preferably made by direct bank deposit, wire transfer, e-transfer, or cheque payable to Center Holidays Inc. Payments made using these methods automatically qualify for a price reduction.

  1. Final Payment Discount

Please note that if the full and final payment is made using one of our preferred payment methods—direct bank deposit, wire transfer, e-transfer, or cheque—you will be eligible for a price reduction of $100 per person. Please speak with our Travel Counselor to confirm your eligibility.

  1. Final Payments made by Credit Card

A completed, dated, and signed credit card authorization form must be on file before any credit card payment exceeding $500 per person can be processed. This form will be sent to you once you advise us that you intend to pay by credit card. Upon receipt of the completed form, Center Holidays Inc. will proceed with processing your payment.

  1. Cancellation Policy
  2. Cancellation Before Final Payment (61+ days prior to departure):

Your deposit is non-refundable. We strongly recommend purchasing comprehensive travel insurance to protect against financial loss should you need to cancel for unforeseen reasons.

  1. Cancellation After Final Payment and 30–60 Days Prior to Departure:

A future travel credit will be issued for all payments received, valid toward any Malaysia Boutique Tours departure within 12 months of the original tour date. Any applicable cancellation fees and non-refundable payments made to third-party travel providers will be deducted. These typically include non-refundable amounts paid to suppliers, hotels, and other travel service providers to secure arrangements on the client’s behalf.

  1. Cancellation Within 30 Days of Departure (29–0 days):

No refunds or travel credits will be issued. We strongly recommend purchasing comprehensive travel insurance to cover potential financial losses in the event of cancellation for unforeseen reasons.

  1. Cancellation Notice

If you need to cancel your trip, you must notify us immediately in writing by email. If you have purchased trip cancellation insurance, certain insurable risks may be covered under your policy. Once the trip has commenced, no partial refunds will be provided for any unused arrangements, including voluntarily missed meals, sightseeing, transportation, or other services. No refunds will be issued to travellers who do not complete any portion of the itinerary for any reason.

  1. Twin Share Terms and Conditions

If you are travelling solo, you may choose to pay a Single Supplement to guarantee a private room throughout the tour. Alternatively, if you are willing to share with a traveller of the same gender, our Twin Share option is available on most tours. Under this option, you will share a room with a same-gender co-traveller and will not be charged the Single Supplement.

  1. Force Majeure

We are not responsible for any additional costs, claims, losses, damages, expenses, delays, or loss of enjoyment of any kind arising from circumstances beyond our reasonable control or that of our suppliers. Such circumstances include, but are not limited to, adverse weather conditions, strikes, cancelled or delayed transportation, fuel surcharges, labour disputes, riots, blockades, war, pandemics, terrorist acts, natural disasters, or government-imposed restrictions.

We reserve the right to cancel departures due to force majeure. If cancellation occurs within 60 days of departure, we will offer to postpone your trip to a comparable departure within 12 months of the original tour start date. If postponement is not feasible due to the circumstances, an alternative option will be offered at the time of notice. We are not responsible for costs associated with visa re-issuance or extensions, airline change fees, or any additional compensation.

We strongly recommend that all travellers purchase comprehensive trip cancellation insurance, either through Center Holidays Inc. or a provider of their choice, to help protect against potential losses arising from such events.

  1. Reservations

If you wish to transfer your booking to a different tour within 60 days of departure, we will make every reasonable effort to accommodate your request. A service fee of $50.00 per change will apply to cover administrative and communication costs. Any upgrades will be charged at the applicable rate. Please note that additional supplier change fees may apply depending on the arrangements booked, and any such fees will be passed on to you.

  1. Travel Insurance

We strongly recommend that all travellers purchase adequate and comprehensive travel insurance for all destinations. Travel insurance may provide coverage for cancellation or change penalties due to unforeseen circumstances, as well as medical and emergency assistance during travel, including coverage for loss or delay. If you choose not to purchase travel insurance, you will be fully responsible for any medical expenses and losses resulting from weather, disruptions, or other unforeseen events. No refunds will be provided for unused or amended travel arrangements in such circumstances.

  1. Inclusions and Exclusions

If you have any questions regarding what is included or excluded in your tour package, please consult your Travel Counselor for clarification.

  1. Travel Documents

It is your sole responsibility to inquire about and obtain all required travel documents. We are not liable for any consequences arising from incomplete, invalid, or missing documentation.

A valid Canadian passport is required for all travel outside Canada. Certain countries require passports to be valid for at least six months beyond the date of return to Canada. Canadian citizens born in specific countries may require a visa in addition to a valid passport. Permanent residents who are not Canadian citizens must carry a valid Permanent Resident Card. A notarized letter of consent may be required when one parent is travelling alone with a child under the age of 18.

Travellers are responsible for confirming document requirements and ensuring all necessary documents are in their possession prior to departure. Failure to provide the required documentation may result in denied boarding or refusal of entry by carriers or authorities, without recourse or refund. Possession of proper documentation does not guarantee entry into another country.

Travel vouchers, hotel details, tickets, and other relevant documentation will be included in your final tour package. For group departures, certain documents may be issued directly to the Tour Leader rather than individual participants. All documentation is provided electronically. A $50.00 processing fee will apply for the reissuance of lost vouchers or documents.

  1. Responsibilities

Malaysia Boutique Tours acts solely as an agent for the owners and operators of transportation, accommodation, and other services included in the tour packages. We are not liable for any loss, damage, injury, delay, or accident resulting from the acts or omissions of any third-party service provider.

We reserve the right to accept or decline any booking request, and to remove any participant from a group or individual travel program if necessary. Itineraries and scheduled arrangements are subject to change. We reserve the right to adjust travel plans as required by circumstances beyond our control.

  1. Confidentiality and Privacy

At Malaysia Boutique Tours, we place the highest priority on protecting our customers’ privacy. We do not sell customer names or any personal information to third parties. All direct communications with us—whether by email, fax, telephone, or postal mail—are treated as confidential.

However, to reserve your trip and process your payment, we require certain basic personal information. When you book or purchase travel services through us, we may need to share your information (including your name and address) with booking/payment processing partners, tour operators, air carriers, or other travel service providers involved in delivering your travel arrangements. This sharing is essential to complete your transaction.

While we take all reasonable steps to protect your privacy, you acknowledge that Malaysia Boutique Tours may disclose certain information to third parties tasked with verifying or corroborating details provided as part of your booking.

Images displayed on our website are for informational purposes only. They should not be relied upon when making your booking and do not form part of this agreement.

  1. Applicable Laws

This agreement is governed by the laws of the Province of Ontario. You agree to submit to the jurisdiction of the courts located in the City of Toronto, Ontario.
